SPET, Turismo de Tenerife, S.A. is adopting or shall adopt the technical and organisational measures necessary for ensuring the security of personal data and preventing their alteration, loss, unauthorized processing or access, with this being done bearing in mind the very latest technology, the nature of the data stored and the risks to which they are exposed, be these due to human action or to the physical or natural environment.

PERSONAL DATA PROCESSING
Controller: In accordance with that established in the current regulations on Personal Data Protection, we would like to inform you that your data will be incorporated into the processing system owned by SPET, Turismo de Tenerife, S.A., the business address of which is Avda. La Constitución, 12 – 38003 Santa Cruz de Tenerife, Spain.
Authorisation: The legal basis for the processing of your personal data is your having given us your consent to do so, with the purpose being the management and fulfilment of the services requested and/or contracted by you. For the management and fulfilment of the relationship, the possible information and/or any other ordinary communication sent to you via the contact channels you provide.
Likewise, at SPET, Turismo de Tenerife, S.A. we treat the information you provide us with in order to manage the outgoing information about the products and/or services that might interest you and thereby improve your experience as a customer and/or user by building up a “commercial profile” based on the information provided. No automated decisions shall be taken based on that profile. The commercial or prospective offer of products and services is based on the consent you are requested to provide without, under any circumstances, the withdrawal of this consent affecting the execution of the contract or provision of the services contracted.
Retention period: The personal data provided shall be held on file for the period strictly necessary to comply with the aforementioned principles, the liability period, throughout the commercial relationship, until deletion is requested by the data subject or for 6 years as of the last confirmation of interest.
If you have exercised or are exercising the right of deletion, cancellation and/or limitation of the processing of your data, we shall keep your information duly blocked and unused for as long as it may be necessary for the lodging or defence of claims or resolution of a judicial, legal or contractual proceeding that might arise regarding the processing of your data that must be attended to and for which the retrieval thereof is required.

Anybody has the right to obtain confirmation as to whether SPET, Turismo de Tenerife, S.A. is or is not processing personal data that might concern them. All data subjects are entitled to access their personal data, to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data is no longer required to fulfil the purposes they were gathered for.
Under certain circumstances, and for reasons related to their particular situations, the data subjects may request the limitation of or opposition to the processing of their data, in which case SPET, Turismo de Tenerife, S.A. shall only keep them, for compelling legitimate reasons, to comply with any current regulations imposed by the administration or to lodge or defend possible claims.

DATA PROCESSING BY THIRD PARTIES
For reasons of organisation, operation, need, etc., SPET, Turismo de Tenerife, S.A. may contract the services of advisors, professionals or similar to process personal data on its behalf. This third-party processing is regulated in a contract, be it in writing or in some other form that enables the accreditation of its execution and content, that expressly stipulates that the data processor shall process the data in strict accordance with the instructions of SPET, Turismo de Tenerife, S.A. and shall not apply or use them for purposes other than those stated in said contract, nor shall they communicate them, not even for their retention, to other persons.
The individual who might have access to the personal data in his or her capacity as an employee is not deemed to be the processor within the working relationship with SPET, Turismo de Tenerife, S.A.
Under no circumstances shall said processing or access be understood as involving an assignment, transmission or transfer of Personal Data.

RECIPIENTS OF PERSONAL DATA
There shall be no assignment, transmission or transfer of personal data except under legal obligation or at the request of the Public Administration, the Ombudsman, the Public Prosecutor or the Judges or Courts or the Audit Commission or the autonomous regional institutions with similar functions to the Ombudsman or the Audit Commission, with this being undertaken within the scope of the functions expressly attributed to them by law.
If there is an assignment, transmission or transfer of personal data outside of the cases provided, the data subject shall be informed in advance and asked to give their consent if appropriate.

Their content does not constitute a commitment for SPET, Turismo de Tenerife, S.A. unless confirmed in writing by both parties. If you read the emails and are not the designated recipient, employee or agent responsible for delivering the message to the recipient, or have received this communication in error, we herewith inform you that any disclosure, distribution or reproduction of this communication is totally prohibited, and may be illegal, and we ask you to notify us immediately and return the original message to the address of the sender.

Exercise of rights

In accordance with the rights conferred by the current regulations governing data protection, you may exercise the rights of access, rectification, limitation of treatment, deletion, portability and opposition to the processing of your personal data, as well as give your consent for the processing thereof by sending your request;

In those cases in which manifestly unfounded or excessive requests are made, especially on a repetitive basis, SPET, Turismo de Tenerife, S.A. may charge a fee that compensates the administrative costs of dealing with the request or refuse to act (the fee will correspond to the cost of processing the application). 

DEADLINES
SPET, Turismo de Tenerife, S.A. shall inform you about the actions derived from your request within a month (this may be extended by two further months in the case of especially complex requests, with this being previously notified). 
Depending on the volume of data and information being processed, SPET, Turismo de Tenerife, S.A. may request that you specify the information referred to in your access request.

PROCEDURE DESCRIPTION
The exercise of rights must be carried out via a communication addressed to SPET, Turismo de Tenerife, S.A., which shall contain: 
Name and surname of the data subject; photocopy of the document that proves the identity of the affected person and, where appropriate, of the person who represents him or her; as well as the document accrediting such representation. 
Petition in which the request is specified. 
Address for notification purposes, date and signature of the person making the request. 
Documents accrediting the petition made, if appropriate. 
In the event of the request being exercised by a legal representative: it shall be necessary to accredit this condition. 
In the event of the request being exercised by a voluntary representative: a copy of his or her National ID Document or equivalent document and the representation conferred thereby shall be provided. 

TELEPHONE request
Since these are extremely personal rights, this medium does not enable the accreditation of the person’s identity. Therefore, this medium shall NOT be implemented. 
You must make your request in writing (by email, postal mail or in person). 

Request made IN PERSON
Please be informed that a reply or response is not necessary immediately or on the spot. This is because there are legal deadlines and the request must be processed according to the procedure described here. 
The corresponding application document shall be provided attaching a photocopy of the valid document that identifies it. As well as the documents that accredit you as the legal or voluntary representative. 
All documentation must be submitted to SPET, Turismo de Tenerife, S.A. REF: Protección de Datos, Avda. La Constitución, 12 – 38003 Santa Cruz de Tenerife, Spain. 
We shall respond to the request within the legally established period. 

Application made by POSTAL MAIL
Requests shall be sent to SPET, Turismo de Tenerife, S.A. REF: Protección de Datos, Avda. La Constitución, 12 – 38003 Santa Cruz de Tenerife, Spain. It shall be verified that it provides enough personal data to accredit the identity of the affected person or representative, if applicable, as well as a photocopy of the document that accredits his or her identity. 
In the event that the request does not meet the requirements specified above, written communication shall be sent to request the formal correction of the request. 

Application made by EMAIL
The requests shall be received via the email address: [email protected] and sufficient personal data to accredit the identity of the person making the request shall have to be provided. 
If the application does not include the required elements due to a failure to observe formal requirements, SPET, Turismo de Tenerife, S.A. shall require the data subject to proceed with the correction by means of an e-mail sent to the address provided by the data subject. 

Claims (Protection of rights) 
If the applicant is of the opinion that he or she has not been properly able to exercise his or her rights, he or she may lodge a complaint with the Spanish Agency for Data Protection (AEPD) in order to initiate a protection of rights procedure. 
This can only be done once the legally established deadlines have elapsed.

The refusal of the file manager to provide the information requested. 
A copy of the request form stamped by the file manager. 
Copy of the registered mail dispatch receipt or a copy of the request bearing the stamp of the post office. 
Any other means of proof provided by the file manager accrediting receipt of the request.

Partners

Informative clause on the processing of data as a partnerIn compliance with the provisions of the current regulations governing Data Protection, SPET, TURISMO DE TENERIFE S.A. (hereinafter TURISMO DE TENERIFE) informs you in an express, precise and unequivocal manner that the entity’s data as well as contact information associated therewith, as well as any other personal data that the partner agrees to provide us with at the time of his or her request will be incorporated into and processed as part of the processing activity called Partners, with SPET, Turismo de Tenerife, S.A. being the controller.

The partner entity must provide TURISMO DE TENERIFE with all the data necessary for the proper implementation of its promotional actions, such as brochures, anagrams, images, characteristics of the services, etc. However, TURISMO DE TENERIFE may use other texts or images available to it for the preparation of its promotional elements. 

The partner shall be responsible for obtaining the appropriate authorisations for the use of images assigned to TURISMO DE TENERIFE, and these shall remain exempt from any third-party claims for such uses. 

As a condition inherent to the services provided by TURISMO DE TENERIFE, and given the purpose of the partnership, the data subject or his or her legal representative authorises the submission of information from TURISMO DE TENERIFE, from the Partners, from Cabildo de Tenerife and/or collaborators, with the purpose being the diffusion of the services and activities of TURISMO TENERIFE. 

The data subject or his or her legal representative authorises TURISMO DE TENERIFE, voluntarily and free of charge, to issue, distribute, disseminate, execute and display the images, logos, contact details and general information of the partner via any medium, be it written, press, television, radio and other traditional communication media, as well as via its website or other web pages it might have, and on social networks such as Facebook, YouTube, Tuenti, Twitter and other online media, and via distribution channels conducive to the marketing of services, activities, products, events, etc., offered by TURISMO DE TENERIFE. 

For the promotional purpose implied by the term partnership, the data provided may be freely assigned to third parties unless expressly indicated otherwise in writing. Bank details and data of a financial nature shall not be assigned. 

The partner understands and accepts that the data provided, as well as the personal contact data published by TURISMO DE TENERIFE as part of its activity, shall or may be consulted and processed by an entity other than TURISMO DE TENERIFE. The partner is therefore informed that TOURISM OF TENERIFE does not assume any responsibility for the use to which other entities other than TURISMO DE TENERIFE put said information and is hereby exonerated from any claim or liability. 

The partner must inform TURISMO DE TENERIFE of any changes that may occur in the data provided and he or she shall be responsible for updating them and for keeping his or her image bank updated. 

Whenever TURISMO DE TENERIFE sends personal data to the partner, the latter shall use them for the fulfilment of purposes directly related to the legitimate functions of the assignor and the assignee and is obliged, on the strength of the communication alone, to comply with the provisions of the current Data Protection regulations.

ContactSPET, Turismo de Tenerife, S.A. uses or may use social networks as a communication channel for promoting its products, events, news, alerts, etc. in a simple and effective way as well as for marketing its brand(s), optimising communication and encouraging the participation of customers, users, consumers, etc. 
SPET, Turismo de Tenerife, S.A. always prevents the publication of content that involves the processing of personal data, with its publishing activity being limited solely to informative or commercial purposes.

Users are informed of the policy regarding the processing and protection of the personal data of those people who voluntarily access and use SPET, Turismo de Tenerife, S.A.’s official social media page/s: 

The accessing and use by users of this/these official page/s run by SPET, Turismo de Tenerife, S.A. implies that they expressly accept the privacy policy of each of the social networks they may access and consent to the processing of their personal data as and how provided therein.

SPET, Turismo de Tenerife, S.A. is not responsible for the actions of users, who shall assume all responsibility for anything that may arise: 

When any information that has not been published or shared by SPET, Turismo de Tenerife, S.A. or, where applicable, that has been published by an external third party appears on the social network. 

When the social network is not operational for technical reasons attributable to the owner of the platform itself, third parties, unforeseeable causes or force majeure, with these circumstances being the responsibility of the social network or, where applicable, of the third party. 

When the social network amends any of its legal notices and/or terms and conditions of use.
